Yet, Anonta Khan, from the company DesignRush, which conducted the study, believes that the situation is not black and white. Alongside low-scoring states such as South Dakota and Alaska, where data breaches are common, there are also states with high security scores, like Kentucky, experiencing fewer cybercrimes. However, she emphasizes, “having strong laws doesn’t always mean a state is safe.”
High security scores don’t necessarily translate into lesser instances of cybercrimes.
For instance, Nevada, with a safety score of 77.64, experienced a number of cybersecurity incidents last year, more than triple the national average. Meanwhile, states like California, despite robust privacy laws, face high rates of cybercrime due to the constant target on the state’s vibrant tech sector.
“This shows that laws need to be enforced well,” asserts Khan.

There has been a resurgence of state-level efforts which are likely to be refined according to the evolution of technology. Artificial Intelligence(AI), for instance, is undergoing regulatory scrutiny, with states contemplating rules akin to Colorado’s Anti-Discrimination in AI Law that comes into effect in 2026.
Data privacy is a ballooning concern, amidst rising cyber threats and legal actions over website tracking, biometric data, and online privacy.
As we navigate through this new era of data privacy protection, businesses should exploit this opportunity to reinforce their cybersecurity mechanisms. According to Ojas Rege, Senior Vice-President at OneTrust, organizations should aspire to comply proactively with the various state privacy laws.
“By moving off spreadsheets, bringing in automation, and designating a senior data privacy leader, organizations can proactively comply with the current wave of US state privacy laws,” says Rege. Thinking ahead also involves taking into account the responsible application of AI, which requires an effective data privacy project as a preliminary requirement and a requisite foundation.
